The short version. Out by Seven helps you build a routine of early nights and early mornings. It is not medical advice. Only go outside when it's safe. Subscriptions renew automatically through Apple until you cancel, and you can cancel any time in your iPhone settings.
1. About these terms
These terms apply to the Out by Seven iPhone app (the "app"), provided by Belvicon Ltd, Spyrou Kyprianou 78, Magnum Business Center, 3rd Floor, 3076 Limassol, Cyprus, company number HE 492478 ("we", "us").
By downloading or using the app you agree to these terms and to Apple's Licensed Application End User License Agreement (the "Standard EULA"). If these terms and the Standard EULA conflict, these terms apply, as far as the law allows. Our Privacy Policy explains how we handle your data.
2. What the app does
Out by Seven helps you go to bed on time, get up when your alarm rings, and get outside in the morning. It includes a morning alarm that stops when you scan your chosen door or object, wind-down and bedtime reminders, an optional late-night app lock using Apple's Screen Time, an outside check with a morning photo, streaks, Rest Days, Rain Checks and a friends leaderboard.
We may improve, change or remove features over time. If we remove a major paid feature, we will tell you in advance where reasonably possible.
3. Your health and safety
- Not medical advice. The app is a habit tool. It does not diagnose, treat or prevent any condition. Sleep needs differ from person to person. If you have a sleep disorder, a health condition, are pregnant, or are unsure whether a routine is right for you, talk to a doctor first.
- Safety first outside. Only go outside when it is safe to do so. Think about darkness, weather, traffic and your personal safety. Never put yourself at risk for a streak. If it isn't safe, use Rain Check or Not safe today in the app.
- Don't use the app while driving or in any situation where looking at your phone could be dangerous.
- Alarms. We work hard to make the alarm reliable, but it depends on your iPhone, its settings, battery and iOS. Keep your phone charged and the app's permissions on. Don't rely on the app alone for anything critical, like a flight or a medical appointment.
4. Subscriptions and free trials
- Out by Seven requires a subscription. Prices and plans are shown in the app before you buy and may differ by country.
- Payment is charged to your Apple ID when you confirm the purchase, or at the end of a free trial.
- Free trial: if a plan includes a free trial, the subscription starts automatically when the trial ends unless you cancel at least 24 hours before it ends. A free trial is available once per Apple ID.
- Automatic renewal: subscriptions renew automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before the renewal.
- Cancel any time in iOS Settings › your name › Subscriptions. You keep access until the end of the period you've paid for. Deleting the app does not cancel your subscription.
- Refunds are handled by Apple under Apple's policies. You can request one at reportaproblem.apple.com.
- Price changes: if we change the price of your plan, Apple will tell you in advance and, where required, ask for your agreement before charging the new price.
- EU right of withdrawal: when you start a subscription or trial, you ask us to give you access to the app's digital content immediately. Where the law allows, you therefore lose the 14-day right of withdrawal once access starts. This doesn't affect your other legal rights or Apple's refund process.
5. Friends and fair play
- Use your real first name or a nickname. Don't use names that are offensive, impersonate someone else, or include contact details or links.
- Only add people who want to be your friends in the app.
- Don't try to cheat the leaderboard, interfere with the app or its services, or access other people's data.
- We may remove a name or a friends profile that breaks these rules, and suspend access in serious cases.
6. Our app and content
The app, its design, the Out by Seven name and logo, and all its content belong to Belvicon Ltd or its licensors. We give you a personal, non-transferable right to use the app on Apple devices you own or control, for your own non-commercial use, as described in the Standard EULA. Don't copy, modify, resell or reverse-engineer the app, except where the law allows it.
Your morning photos are yours. They stay on your iPhone, and we don't claim any rights in them.
7. Availability
We aim to keep the app and the friends feature running smoothly, but we can't promise they will always be available or error-free. Some features depend on Apple services such as iCloud, Screen Time and alarms, which are outside our control.
8. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your mandatory rights as a consumer.
Otherwise, as far as the law allows, we are not liable for indirect or unforeseeable losses, for losses caused by your iPhone, its settings or third-party services, or for missed appointments or other consequences of an alarm not ringing. Our total liability to you is limited to the amount you paid for the app in the 12 months before the claim.
9. Ending the agreement
You can stop using the app at any time by cancelling your subscription and deleting the app. We may suspend or end your access if you seriously or repeatedly break these terms. If we stop providing the app altogether, we will tell you in advance where possible.
10. Changes to these terms
We may update these terms, for example when we add features or when the law changes. We will update the date at the top and, for important changes, tell you in the app. If you keep using the app after a change takes effect, the new terms apply.
11. Law and disputes
These terms are governed by the laws of the Republic of Cyprus. If you are a consumer living in the EU or another country, you also keep the protection of the mandatory laws of your country, and you may bring a claim in the courts where you live. Before going to court, please email us. We'd much rather sort things out with you directly.
12. Apple
These terms are between you and Belvicon Ltd, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance for it, and is not responsible for any claims relating to it, as set out in the Standard EULA. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
